WORKERS’ COMPENSATION CHANGES FOR THE CONSTRUCTION INDUSTRY

April 2009 - Knoxville Shareholder, John J. Britton, presented a seminar entitled “Workers’ Compensation Changes for the Construction Industry” which was sponsored by Shafer Insurance Agency, Inc. This seminar reviewed general principles of Tennessee Workers’ Compensation Law as it applies to the construction industry and focused on the effect that Public Chapter 1041, passed on May 28, 2008, had on Tenn. Code Ann. §50-6-113 dealing with the liability of the principal, intermediate contractor, or subcontractor for workers’ compensation benefits.

WALDROP AND HOLBROOK PRESENT “NEW LIEN LAW AND RETAINAGE STATUTES
August 2007 - two Lewis King lawyers presented “New Lien Law and Retainage Statutes” an all day seminar concerning the new lien laws and retainage statutes in Tennessee that took effect in mid-2007. Loy Waldrop and Jimmy Holbrook, members of the firm's Construction Practice Group and founding members of the Tennessee Association of Construction Counsel, presented a program that took an in depth look at the impact of the new statutes concerning liens and retainage in Tennessee will have on contracts, claims, litigation, and related matters. A large crowd of attendees from multiple industry disciplines, including contractors, architects, engineers, owners, and attorneys were in attendance. In addition, Mr. Holbrook has since presented in-house seminars to clients concerning construction industry topics including contracts, new lien/retainage statutes, employment, and immigration compliance issues.

SEVIERVILLE LAWYER PRESENTS SEMINAR ON “RISK AVOIDANCE”
In August 2006, Lars Schuller, a resident of the Sevierville office of Lewis King presented a seminar on “Risk Avoidance” to area realtors in a program sponsored by the Greater Smoky Mountain Association of Realtors. The seminar was approved by the State of Tennessee for Real Estate License continuing education credit. At the seminar, Lars Schuller presented facts of actual cases and discussed the merits of each of them. Further, he explained the applicable law and court ruling as it related to risk avoidance for the group of realtors.

LEWIS KING LAWYERS PRESENT SEMINAR TO
THE SOUTH CAROLINA SOCIETY OF PROFESSIONAL LAND SURVEYORS

June 2006, three Lewis King lawyers presented a program to the annual convention for the South Carolina Society of Professional Land Surveyors. At that time, John Buckingham, Joe Christian and Linda Mowles presented a program on the application of copyright laws to documents prepared based on the work performed by surveyors and the interaction of copyright and public domain as it relates to facts alone. Over 100 members attended the three-hour seminar that was prepared and presented by Lewis King, making it the most highly attended sessions of the convention.

BUCKINGHAM AND BRITTON PRESENT LORMAN EMINENT DOMAIN SEMINAR
John Britton and John Buckingham, two Lewis King lawyers residing in Knoxville, presented a Lorman Education Series seminar on eminent domain in Tennessee across the state earlier this year. Buckingham covered topics ranging from general direct condemnation issues, such as jurisdiction, parties, and pleadings, to issues involved in the concept of just compensation such as fair market value, remainder damages, and comparable sales. Britton’s presentation involved topics ranging from inverse condemnation issues, such as the nature of the remedy, who may bring an action, statute of limitations, pleadings, and the distinction between inverse condemnation and trespass actions. He also addressed admissibility of value opinion evidence in the trial of direct or inverse condemnation cases.

More than 70 attendees were present for the programs. They consisted of an interesting mix of attorneys from private practice, in-house corporate counsel, and government attorneys. There were also a number of engineers, Tennessee Department of Transportation officials, appraisers, and real estate brokers.

Buckingham has almost 30 years of experience handling eminent domain cases for the United States Attorney’s office (various agency takings for the Appalachian Trail), and other projects, the state Attorney General’s office (TDOT highway takings), municipal takings for road widening, and many years of representing landholders in a variety of takings cases. Britton has 25 years of experience handling eminent domain cases for the attorney general’s office (TDOT highway takings), county and municipal takings, and years of representing landholders in a variety of takings cases.

GIORDANO LEADS PRACTICE MANAGEMENT PROGRAM FOR INNS OF COURT
Knoxville shareholder Lawrence Giordano presented a recent program to the Hamilton Burnett Chapter of the American Inns of Court in Knoxville. The subject of the program was practice management techniques for regaining control of the practice of law.

COLE AND JACKSON PRESENT HR POLICIES AND PRACTICE PROGRAM
In September 2006, Lewis King Nashville shareholder Lisa Ramsay Cole and associate Samuel L. Jackson presented a seminar on employment law titled “Assessing Your HR Policies and Practices: Compliance with State and Federal Employment Laws in Tennessee.” The seminar was designed for human resources directors or employees and gave instruction on hiring, termination and disciplining employees. The program also focused on compliance with important state and federal regulations and laws governing employment relationships.
